Trump ‘Is Not Under Investigation,’ His Lawyer Insists

Jay Sekulow made the assertion on CBS’s “Face the Nation,” though he acknowledged that he had no way of knowing for sure.

WASHINGTON — A member of President Trump’s legal team said on Sunday that the president was not under investigation by the special counsel looking into Russian meddling in the election, despite a tweet from Mr. Trump on Friday that seemed to acknowledge that he was a subject of the inquiry.

Jay Sekulow, who is part of a group of personal lawyers Mr. Trump has hired to respond to the special counsel, said the president was merely responding to reports in the news media that said he was now a subject of the expanding investigation.

“The fact of the matter is the president has not been and is not under investigation,” Mr. Sekulow said on the CBS program “Face the Nation.”

“The president issued that tweet on social media because of the report in The Washington Post from five anonymous sources, none of which, of course, anyone knows about,” Mr. Sekulow added.

On Friday, Mr. Trump wrote on Twitter: “I am being investigated for firing the FBI Director by the man who told me to fire the FBI Director! Witch Hunt.” He was referring to a letter that the deputy attorney general, Rod J. Rosenstein, wrote regarding the dismissal of James B. Comey as F.B.I. director.

Mr. Sekulow said that because he and the president had not received any kind of notice from investigators on the special counsel, that meant Mr. Trump was free from official scrutiny. But he acknowledged that he had no way of knowing for certain that Mr. Trump was not a subject of the inquiry.

“What we know is what James Comey said,” Mr. Sekulow said. “The last thing we know is when he testified just a couple weeks back — that the president was not and is not a target of investigation.”

“I can’t imagine a scenario where the president would not be aware of it,” Mr. Sekulow said.
